Progressive seeks ruling it owes nothing for Houston trucking crash claim

Progressive, in a federal case filed Aug. 13, 2026, argues the incident involved an unlisted 2005 Volvo tractor and non-rated driver, and it also asks for confirmation the policy does not cover punitive damages.

Progressive Express Insurance Company is suing to block payment on a trucking-crash bodily-injury claim tied to a highway incident on US 290 in Harris County, Texas, according to a declaratory judgment complaint filed in federal court in Houston on Aug. 13, 2026.

The filing describes a tractor-trailer crash on Sept. 15, 2023, after a vehicle ahead swerved to avoid a wreck and the tractor-trailer hit a concrete barrier. A motorist proceeding in the opposite direction alleges she was injured when another vehicle moved to avoid debris and the vehicles made contact, and she later sued the trucking company MMT Carriers and the driver for negligence.

Progressive argues that almost none of the crash matches the commercial auto policy it issued for the period May 2023 to May 2024. The policy, the complaint says, listed one power unit, a 2012 Freightliner Cascadia, while the involved tractor was a 2005 Volvo 780 pulling a 2015 utility trailer that were neither listed on the declarations nor reported to the insurer, and the insurer says it was never notified about their acquisition or operation.

The complaint also says the driver was not one of the three rated drivers and that Progressive was not notified of him. It further challenges applicability of the MCS-90 endorsement, which guarantees motor carrier public-liability payments, and asks the court to confirm the policy provides no coverage for punitive damages that the injured motorist is seeking in the underlying state-court case.
