AI-related suits boost securities class action filings in H1 2026
Core filings rose to 117 in H1 2026, and AI-related cases drove outsized losses, contributing 73% of total DDL and MDL, according to Cornerstone Research and Stanford Law School.
Securities class action filings increased sharply in the first half of 2026, reaching 121, up from 93 in the second half of 2025, according to the 2026 Midyear Assessment of Securities Class Action Filings by Cornerstone Research and the Stanford Law School Securities Class Action Clearinghouse, as summarized by Risk & Insurance.
The report found core filings climbed to 117 in H1 2026, compared with 90 in H2 2025. It also said the Disclosure Dollar Loss Index rose to $529 billion in H1 2026 from $299 billion in the prior six-month period, while the Maximum Dollar Loss Index increased to $1,858 billion from $1,000 billion.
AI-related lawsuits were the standout driver, with 15 filings in the first half of 2026. Risk & Insurance reported that, of those cases, seven concerned AI development, five involved data centers, and four targeted AI infrastructure or hardware, and that there were no AI-related filings tied to autonomous vehicles in the period.
While AI-related filings made up 13% of total core filings, they accounted for a disproportionate share of market capitalization losses. Cornerstone Research reported that AI-related cases generated $385 billion of disclosure dollar loss, or 73% of the total, and $1,349 billion of maximum dollar loss, also 73% of the total. The report further said two AI-related filings alone accounted for $1,235 billion, or 66%, of the relevant maximum dollar loss figures, though the text provided cuts off after that point.
