Newrez, dba Shellpoint, faces RESPA suit in New Jersey

The complaint alleges Shellpoint received a reinstatement notice dated June 22, 2026 only around June 30, leaving one day before a July 1 payment deadline.

HousingWire reports that a New Jersey homeowner has sued Newrez LLC, doing business as Shellpoint Mortgage Servicing, alleging violations of federal and state law tied to mortgage servicing and loss mitigation. The suit was filed July 8 and amended July 16 in the Superior Court of New Jersey, Law Division in Essex County, according to court records cited by HousingWire.

The plaintiff, Autumn M. Urling, alleges Shellpoint delayed decisions, provided inconsistent information, and mishandled requests for mortgage assistance over an extended period. She claims the conduct deprived her of a meaningful opportunity to avoid foreclosure and caused financial losses, putting both her home and home based business at risk.

Urling’s complaint alleges Shellpoint issued a reinstatement notice dated June 22, 2026 but she received it about June 30, leaving only one day before a July 1 payment deadline. She also claims she submitted multiple loss mitigation applications, notices of error, and requests for reconsideration, while the company continued foreclosure activity during the unresolved period.

The lawsuit further alleges Shellpoint failed to provide a written explanation for the denial of a change of circumstances request, which included a proposed $50,000 contribution toward resolving the default. HousingWire says the company did not respond to a request for comment at the time of publication.
