US prosecutors seek CLARITY Act changes as Senate vote window shrinks
Proposed edits would limit provisions on developers under the Digital Asset Market Clarity framework, as lawmakers weigh a bill ahead of an Aug. 7 to Sept. 14 state work recess.
US prosecutors and prosecutors’ associations are asking the White House to adjust provisions in the Digital Asset Market Clarity, or CLARITY, Act as a potential Senate vote nears, according to Cointelegraph, citing a Politico report.
Cointelegraph said organizations representing law enforcement officials, the National Association of Assistant US Attorneys and the National District Attorneys Association, sent a letter to the White House requesting changes to parts of the CLARITY package that relate to the Blockchain Regulatory Certainty, or BRCA, including language that would have developer guidelines avoid creating, expanding, or modifying criminal liability under federal law.
In response to the reported proposed edits, Cointelegraph reported that White House crypto adviser Patrick Witt said the provisions were “not even close” to the Trump administration’s position, adding that it did not appear to result from productive negotiations.
Cointelegraph also reported that Senator Catherine Cortez Masto has been pushing the White House to address the BRCA before any vote, while the bill faces broader Democratic pushback tied to ethics rules related to President Donald Trump’s crypto investments and with Senate Majority Leader John Thune not scheduling a vote before the Senate state work periods from Aug. 7 to Sept. 14.
