SEC draft 2026-30 strategic plan signals shift in digital asset policy
The SEC said it will refocus enforcement on clear violations of established law, particularly fraud and manipulation, rather than expanding its reach through novel theories.
The Securities and Exchange Commission has released a draft strategic plan for 2026 to 2030 that, according to HousingWire, signals a policy shift toward supporting innovation and capital formation and away from what it characterizes as regulation by enforcement.
The plan lays out three main goals, including greater engagement with market participants and streamlining the SEC’s own operations. It also calls for a more rational, coherent and principled regulatory framework for digital assets and distributed ledger technology, reflecting concerns that the current patchwork has left innovators without legal certainty.
For fundraising, the SEC’s draft says it would expand access to private markets and modernize rules, including an enhanced Regulation A approach as an alternative to a full IPO. Any new rule would require rigorous cost-benefit analysis and must avoid adding needless friction to the market, HousingWire reported.
On enforcement, the SEC’s draft directs the agency toward clear violations of established law, especially fraud and manipulation, and proposes judging enforcement success by deterrent effect and market clarity rather than case counts or fine totals, HousingWire said. The plan also mentions specific rules for retrospective review, including those covering foreign private issuers, private fund reporting and executive compensation.
