EU MiCA rules set a deadline as U.S. crypto oversight stays fragmented

MiCA has required full authorization for EU crypto firms since the July 1, 2026 deadline, while U.S. oversight remains split across the SEC, CFTC, FinCEN, and states.

CoinDesk says the EU’s MiCA framework is becoming a benchmark for how crypto regulation may evolve in the United States, emphasizing that governance and controls need to be aligned early.

The newsletter describes a fragmented U.S. regulatory landscape where the SEC oversees some areas, the CFTC covers others, FinCEN handles parts of compliance, and state requirements add additional layers, leaving no single master playbook.

By contrast, it says the EU finished writing MiCA in 2023, implemented it through 2024, and has been enforcing it since, with a grace period ending and, as of July 1, 2026, firms that serve EU clients needing full authorization or winding down.

CoinDesk also outlines what MiCA requires for crypto services such as custody, advisory, or exchange, including licensing and regulator oversight, segregation of client assets with independent audits and real time monitoring, capital and transparency requirements, and risk explanations in plain language; it argues that weaker controls have produced major losses and enforcement actions in past U.S. and exchange cases including FTX and Binance.
