Texas HOA boards face new governance and notice requirements

New Texas laws expand open-meeting notice rules and require written enforcement policies, adding formal steps for fines, assessments and other board actions.

HousingWire reports Texas homeowners association boards are dealing with heavier operational and governance burdens as communities grow and new state requirements take effect. The outlet points to Texas Senate Bill 1588 and House Bill 614, which increase formalities around how boards deliberate and communicate with homeowners. SB 1588 took effect in 2021, expanding meeting notice requirements and identifying decisions that generally must be considered and voted on during an open board meeting with prior notice to owners.

HousingWire says the law also raises advance notice for regular board meetings from 72 to 144 hours when notice is posted and emailed rather than mailed. It further lists the types of matters that typically require prior notice, including fines, assessment increases, special assessments, foreclosure actions, annual budgets, certain enforcement matters, and major capital improvements.

The outlet adds that House Bill 614 requires associations authorized to levy fines to adopt a written enforcement policy. HousingWire concludes that the added requirements make it more important for boards to have consistent processes for agendas, communication, and recordkeeping so volunteer directors can respond consistently and keep HOA management manageable.
