Mashinsky settlement imposes lifetime ban with conditional $35M payments
The New York deal lets a qualifying DOJ payment cover $10 million of a $25 million damages obligation, while a separate $10 million judgment can be satisfied by completion of his federal prison sentence, with exceptions.
Alex Mashinsky, the founder of bankrupt crypto lender Celsius, agreed to a permanent ban from the securities, commodities, and crypto business under a New York settlement announced on Oct. 9, according to CryptoSlate.
The agreement includes conditional state payment obligations of up to $35 million, and it is described as not creating a new payout to Celsius creditors, while resolving New York’s civil suit filed in January 2023 and adding conditions tied to a separate federal criminal case.
Under the settlement, Mashinsky’s first obligation is $25 million in damages to New York. CryptoSlate reports the damages obligation is deemed satisfied by a qualifying $10 million payment to the US Department of Justice under his federal forfeiture order, with DOJ payments after May 20, 2025 counting dollar for dollar toward that $10 million, and if the specified payment is not made, the full $25 million is due to New York’s attorney general.
The second obligation is a separate $10 million monetary judgment payable to New York. CryptoSlate reports it is deemed satisfied by completion of Mashinsky’s imprisonment under the federal judgment entered May 12, 2025, subject to express exceptions, and he is serving a 12-year prison sentence.
