Engineers and architects push lawmakers to address condo defect suits

Engineers and architects working on luxury condominiums say it is becoming harder to exit projects after their final sign-off as construction-defect lawsuits rise, particularly over cracks, roofing failures, and water intrusion, according to Bisnow.
Bisnow reports that more condo buyers are filing complaints, which can increase insurance premiums for architecture and engineering firms, or push insurers to stop covering them altogether.
Speakers at Bisnow’s South Florida Construction and Development Forum said they are seeking legislative help. They pointed to Florida statutes that allow new condominium associations to inspect for defects and request repairs before a lawsuit, noting that claims often turn into litigation when developers miss fix deadlines so liability insurance can be used to cover repairs.
The outlet also tied the problem to broader pressure on professional liability insurance, saying claim severity has increased amid social inflation, economic uncertainty, and emerging risks including artificial intelligence and climate change.
