Louisiana crypto ATM users can demand full refunds from unlicensed operators

Act 482 takes effect Aug. 1, requiring operators to acknowledge refund requests within 10 business days and complete covered refunds within 90 calendar days.

Louisiana’s new law starting Aug. 1 lets users cancel a virtual-currency-kiosk transaction made on or after that date and seek a full refund if the kiosk owner or operator was unlicensed at the time of the transaction, CryptoSlate reports. The refund obligation is placed on the operator, with eligibility tied to the operator’s license status during the transaction rather than after.

The measure also preserves Louisiana’s general 72-hour framework, which requires an operator to hold a transaction for 72 hours or allow cancellation within that window for a full refund, according to CryptoSlate. For requests made under Louisiana statute R.S. 6:1389(B), operators must acknowledge and respond within 10 business days, and their response must clearly spell out the requirements to obtain the refund.

The law requires kiosk operators to provide live support through a toll-free number shown on the machine and included on the transaction receipt during kiosk operating hours. If a request is based on suspected fraud, an operator may require proof of a police or other governmental-entity report and proof of identification, and a police report or proof the user filed with the FBI’s Internet Crime Complaint Center qualifies under the act.

CryptoSlate also notes the backdrop of reported fraud, citing FBI Internet Crime Complaint Center figures that recorded 144 Louisiana cryptocurrency-kiosk complaints and $2,874,450 in adjusted losses for 2025, with the FBI warning that some complaints may involve other transaction types beyond kiosks. A covered refund must be completed within 90 calendar days of the initial request, or 90 days from later submission if the operator’s clearly communicated policy requires additional documentation.
