U.S. crypto Clarity Act stalls in Senate as oversight gaps loom

The U.S. crypto industry is facing a setback after the Digital Asset Market Clarity Act failed to win a procedural vote in the Senate this week, with lawmakers effectively heading into a summer break. CoinDesk reports that the missed window reduces the odds that a tailor-made law defining how crypto securities and commodities are handled will be delivered this year.

Without the legislation, the United States may not clearly set distinctions among crypto asset types, nor specify which agency is responsible for overseeing the companies that manage them. CoinDesk notes that a key concern is whether the CFTC would receive explicit authority to govern the commodity trading that underpins much of crypto market activity.

CoinDesk also points to the issue that, without the ability to put the CFTC in place to supervise token trading, oversight authority could remain fragmented even as the SEC and CFTC continue using existing powers. The article describes expectations that the SEC and CFTC would lean on position statements and their current authorities to bridge gaps while Congress does not act.

The piece adds that some crypto insiders have privately downplayed the need for bespoke legislation to keep operating in the U.S., despite warnings that crypto companies and developers could relocate offshore if the act does not move forward. It also frames the stalled outcome as an immediate blow to efforts to establish clearer policy routes for token-based products.
