Lawsuits target Taco Bell and Taylor Farms over cyclospora outbreak

Court filings allege the companies failed to warn consumers, and claim the illnesses tied to the outbreak included stomach aches, diarrhea, fatigue and dehydration, with two deaths reported in the complaints.

Insurance Journal reports that multiple proposed class-action lawsuits have been filed over a nationwide cyclospora outbreak, naming Taco Bell and Taylor Farms and alleging contaminated lettuce was sold to consumers.

The complaints say the parasite risk was avoidable and that the defendants failed to warn customers. In one federal case filed in California’s Central District, lead plaintiff Michael Giles of Brooksville, Florida, alleges Taylor Farms sold iceberg lettuce to Taco Bell restaurants in multiple states, and describes resulting sickness including stomach aches, diarrhea, fatigue and dehydration.

A separate proposed class action in the Northern District of California names West Virginia resident Lawrence Null’s attorneys, who argue the companies’ removal of the lettuce indicates the product was not fit for sale. That suit also points to prior alleged contamination history involving Taylor Farms produce, and says it should have put the company on notice of risk in its supply chain.

The reporting also notes an additional state-court case in Ohio, where a Youngstown man’s complaint alleges severe symptoms such as excruciating abdominal pain, severe gas and bloating, diarrhea, and nausea that led to a hospital admission. Taco Bell and Taylor Farms have not yet answered the suits or sought dismissal, according to Insurance Journal.
