Police calls may not remove a holdover after home closing
Real estate lawyers say calling police usually does not solve the problem when a previous owner refuses to leave after the buyer has already closed and taken legal title.
According to Yahoo Finance, after closing the buyer becomes the official legal owner, but if the buyer agreed to a post-closing stay, the former owner can effectively become a holdover or tenant under state law and the terms of any post-closing occupancy agreement included in the contract.
In that situation, the next steps depend on what the parties agreed to in the post-closing paperwork, including whether the document created a landlord-tenant or occupancy relationship and whether it granted the former owner continued rights to remain.
