NYC 485-x filings cluster below 100 apartments due to cost thresholds

In New York City, the 485-x tax incentive is intended to restart rental construction at meaningful scale, but filings appear to be shaped by how the program’s rules affect developers differently than policymakers. Commercial Observer reports an analysis of 312 registrations through April 2026 shows just three projects, or 0.9 percent, include 100 apartments or more. The remaining 99.1 percent stay under 100 units, with a median project size of 24 apartments, and nearly one-third listing 10 units or fewer.
The publication notes a key caveat: the registry shows prospective applicants rather than completed buildings, so it cannot prove a specific intent for any one project. Still, it says the repeated pattern of addresses stopping at 99 units across multiple sites is consistent enough to matter.
Commercial Observer attributes the clustering to developer feasibility thresholds. Developers view the 100-unit line as a cost boundary, because under the commonly selected structure that pairs a 35-year exemption with a 20 percent affordability requirement, crossing 100 units triggers additional labor obligations. The report says prevailing-wage requirements can increase hard costs by roughly 18 to 28 percent depending on building type and labor mix.
The outlet adds that for a typical mid-rise building, that could translate to about $45 to $65 per square foot, or $6 million to $12 million on a 120 to 150-unit project. At current borrowing costs and rent levels, it can shift a project from financeable to not financeable, leading some developers to split sites into smaller buildings of 70 to 99 units to preserve the tax benefit while avoiding the wage trigger, with examples of multiple 99-unit entries across different streets and addresses.
