SEC proposes Regulation Crypto to oversee token fundraising

The SEC’s proposal starts a public comment window of 60 days, with the rules shaped by how much funding a startup seeks and how it operates.

CoinDesk reports that the U.S. Securities and Exchange Commission published its proposed Regulation Crypto rulemaking, outlining how the agency wants to oversee fundraising by digital asset firms that use tokens.

The proposal lays out different requirements depending on factors such as the amount of funding a startup is trying to raise and how it plans to operate, and it aims to clarify how token fundraising can proceed without running afoul of the SEC.

CoinDesk also notes that under the current presidential administration, the SEC has relied more on staff statements than formal rulemaking, so the timeline to finalize any rules and allow companies time to comply is expected to take time.

Separately, CoinDesk says President Donald Trump urged Congress to pass the Clarity Act, and at a related event SEC Chair Paul Atkins and CFTC Chair Mike Selig spoke alongside industry executives, with the CFTC saying it is ready to begin rulemaking if the Clarity Act does not become law.
