Default servicing failures show up in foreclosure handoff gaps

Foreclosure activity rose in July 2026, while invoice and document handoffs were tied to missed milestones and denied invoices for mortgage servicing parties.

Default servicing issues often do not occur in a single moment, but during handoffs between mortgage investors or funds, the servicer translating requirements, and the law firm executing work, according to HousingWire.

When context is missing, milestones can be missed and incomplete documentation can lead to invoice denials, while unclear ownership can leave balances aging and delays cascading across systems, vendors, policies, and approvals as foreclosure volume rises.

HousingWire cited ICE data for July 2026 showing 38,600 foreclosure starts, up 23% year over year, with active foreclosure inventory up 43% and completed sales up 14%. It also said rising foreclosure activity increases the number of files that move through those handoffs and processes.

Across two multiyear engagements described by HousingWire, O.L.A.F. documented 160,009 invoice submission events and reviewed proposed write off records, estimating 99.30% expected collections over one review period versus 0.70% proposed write offs, and 99.71% expected collections versus 0.29% proposed write offs over another. The outlet added that after all identified write offs, O.L.A.F.’s combined expected collections were estimated at 99.43%, which HousingWire said is 6.43 percentage points above a 93% average cited in Clio’s 2025 report.
