Sitzer commission settlement appeal faces renewed setbacks in 8th Circuit
The Eighth Circuit denied rehearing requests from objectors Monty March and Robert Friedman, while a separate petition linked to the Gibson settlement remains pending, as attorneys dispute nearly $40 million in fees.
The Eighth Circuit denied rehearing requests from objectors challenging the final approval of the Sitzer Burnett commission settlement, according to HousingWire.
Objectors Monty March and Robert Friedman sought rehearing but lost, and Friedman also filed a separate rehearing petition related to the appeals court’s decision to uphold the final approval of the Gibson commission settlement in mid-September.
HousingWire reports that the court has not yet ruled on the pending Gibson-related rehearing petition, after both the Sitzer Burnett and Gibson settlements were upheld by the appeals court late this summer.
In related proceedings tied to the Tuccori homebuyer commission lawsuit, attorneys for plaintiffs in the Batton homebuyer commission lawsuit have requested nearly $40 million, about one third of the settlement fund, for services, HousingWire said.
