Illinois pushes back start of 0.2% crypto digital asset tax to mid-2027

The state asked the court to temporarily block the tax and postpone its effective date while the constitutional challenge continues.

Illinois officials agreed to delay the start of the state’s 0.2% Digital Asset Tax from Jan. 1 to July 1, 2027, after a joint motion filed in Sangamon County Circuit Court, according to Decrypt.

The filing asks the court to preliminarily enjoin the tax, or temporarily block it, and to stay its effective date until July. Because the motion is stipulated, both sides are seeking the same outcome, but the judge still must approve it.

The delay is tied to a lawsuit brought by the Chamber of Digital Commerce, known as The Digital Chamber, and the Illinois Blockchain Association against Illinois Department of Revenue Director David Harris and Illinois Attorney General Kwame Raoul.

Decrypt reports the parties said the delay does not end the case, and the industry groups are still challenging whether the tax is constitutional and enforceable.
