Illinois seeks delay of digital-asset tax collection to July 2027

The Oct. 1 joint motion asks to postpone the Jan. 1 start, and if granted it would temporarily spare brokers from collecting the tax while the constitutional challenge proceeds.

Illinois officials have joined crypto industry groups in asking a judge for a six-month delay to the state’s digital-asset tax collection timeline, according to CryptoSlate.

The Oct. 1 joint motion, filed in Sangamon County, requests postponing the levy’s Jan. 1 start until July 1, 2027, while a constitutional challenge brought by The Digital Chamber and the Illinois Blockchain Association remains pending.

Revenue Director David Harris and Attorney General Kwame Raoul joined the request even as Illinois continues disputing the industry groups’ claims, the report said. If the delay is granted, an injunction would temporarily spare brokers from collecting the tax and defer related liabilities for covered customers.

The report said Illinois enacted the digital asset tax in June and that the law remains in force. The joint filing does not concede the law is unconstitutional, and it does not seek repeal, instead aiming to preserve both legal positions while the lawsuit and the state’s rulemaking process continue.
