US Supreme Court to hear Colorado climate tort case against oil firms
Arguments are set for Oct. 5 in Suncor v. Boulder, with the justices to decide whether state tort claims for climate damages are preempted by federal law.
In 2018, Colorado local officials sued oil companies in state court, alleging that pollution from fossil fuels contributed to global warming and harmed Coloradans through extreme summer temperatures, more frequent wildfires, and higher risk of some insect-borne diseases, according to Insurance Journal.
The outlet said the case became more legally notable as climate attribution science advanced, allowing advocates to try to use event specific climate evidence in court, even though the original complaint did not cite scientific evidence that the field developed later.
Insurance Journal reports the dispute is now before the US Supreme Court, which will hear arguments on Oct. 5 in Suncor v. Boulder.
The key question for the justices, the outlet said, is whether climate lawsuits can proceed under state tort law or whether federal law preempts such claims, a decision that could leave open or close pathways for similar suits seeking climate damages.
