Thailand finalizes rules for domestic Bitcoin and Ethereum ETFs

Thailand’s SEC framework takes effect Oct. 16 and initially allows Bitcoin and Ethereum ETFs while barring retail access to competing foreign crypto ETFs.

Thailand has finalized rules allowing domestic Bitcoin and Ethereum ETFs, but with restrictions that limit retail access to competing overseas crypto products, the country’s securities regulator announced. The Securities and Exchange Commission said 11 regulatory notifications under the framework will take effect Oct. 16 for crypto ETFs listed exclusively on the Stock Exchange of Thailand.

Under the new approach, Thailand will initially prohibit the issuance and offering of investment products linked to foreign crypto ETFs, including depositary receipts that could let local investors access overseas funds through domestic markets. Securities companies will also be restricted from facilitating investments in foreign crypto ETFs for clients who do not qualify as institutional or ultra-high-net-worth.

The move comes as spot Bitcoin and Ethereum ETFs have gained traction in the United States, drawing about $70.37 billion in combined cumulative net inflows since launch, according to CryptoSlate. Crypto data cited in the report also shows the funds held about $121 billion in combined net assets as of Oct. 12, highlighting the scale Thailand is aiming to tap while applying its own limits.
