Influencer lawsuits drive demand for specialized coverage as creators expand
Specialist insurer Beazley says many creators now operate like publishers but often lack legal review, compliance support, or insurance protection.
Social media influencers are increasingly facing legal actions tied to defamation, copyright, privacy, and regulatory claims as their content businesses grow into global media brands, creating new demand for insurance coverage, according to Risk & Insurance.
Beazley, a London-based specialist insurer, said influencers often have audiences that can rival major newspapers, yet they may operate without legal review, compliance teams, or insurance protection. Angela Weaver, Focus Group Leader for Media & Entertainment at Beazley, said influencers do not always view themselves as publishers, but they function as such.
One recurring litigation risk involves the use of copyrighted music in sponsored videos, where creators may be unaware that commercial use can require licenses. Risk & Insurance noted that the issue can expand to brands as defendants when they repost influencer content that includes unlicensed music.
Weaver said music companies can target brands based on the combined volume of unlicensed music across their social media and influencer partnerships, highlighting a broader exposure beyond individual creators.
