Senate Democrats reject Clarity Act ethics language, Thune doubts a pre-August vote

The enforcement dispute centers on who can police the rules, and the latest draft includes a Department of Justice as the sole enforcer while includes a digital asset restriction and sunsets in 2029.

Senate Democrats have rejected the GOP revised ethics language in the latest draft of the Clarity Act, escalating a dispute over how the measure would be enforced for crypto market rules. According to Bitcoin Magazine, Majority Leader John Thune said he doubts the crypto market-structure bill can pass before the August recess, putting its timeline in doubt.

Democrats said they will not accept an ethics provision that names the Department of Justice as the sole enforcer, citing distrust of the Trump Justice Department to police the president. The earlier talks also stalled over the potential role of state attorneys general in enforcing the rules, a point that has complicated negotiations.

The new GOP draft, described by Bitcoin Magazine, would bar federal officials from issuing digital assets and would sunset in 2029, while the White House has pushed Democrats to accept it. The ethics language was based on an agreement involving the White House and Republican Senators Cynthia Lummis and Bernie Moreno, with Lummis defending the approach as robust.

The conflict is tied to enforcement concerns, and the article notes the ethics fight traces back to President Trump’s crypto ventures, with a July disclosure showing more than $1 billion in income over the past year. Bitcoin Magazine also reports seven Democrats led by Angela Alsobrooks said the text falls short on consumer protection and illicit finance provisions.
