xAI sues Minnesota to block AI nudification law set for Aug. 1

The Minnesota law allows civil penalties of up to $500,000 per image and applies strict liability even when platforms filter nudification attempts.

xAI, Elon Musk's AI company, filed a First Amendment lawsuit against Minnesota Attorney General Keith Ellison to block HF 1606, the state's AI nudification law that is scheduled to take effect on August 1, according to Decrypt.

The complaint says the statute is designed to address AI tools that digitally remove or alter clothing in real photos of real people without consent, but xAI argues Minnesota’s definition is overly broad and would expose protected speech and visual expression to civil liability.

xAI alleges the law imposes strict liability on platforms, with up to $500,000 in civil penalties per image generated, and that there is no safe harbor for providers that actively prohibit or filter nudification attempts.

In its filing, xAI also argues the law could be triggered by realistic AI images involving body parts such as the inner thigh, buttocks, or breast, and it says liability could attach even if the depicted person consented or created the image themselves, or if the image is never shared.
