Texas driver sues Allstate over alleged wrong at-fault identification

A Texas driver has sued Allstate Fire and Casualty Insurance Company, alleging the insurer identified the wrong person as the at-fault driver in connection with his auto claim and later refused to respond to discovery requests tied to the issue, according to a complaint summarized by Insurance Business.
The driver filed the case in federal court in Houston on Aug. 3, 2026, stemming from a crash on July 12, 2023 in which the filing says another vehicle struck his. The complaint says the driver complied with policy obligations, including cooperation, timely reporting, and providing requested information.
At the center of the dispute is who was driving, with the filing alleging Allstate submitted Bates-stamped exhibits in earlier proceedings naming one person, not that person's parent, as the at-fault driver, and that those filings amount to binding judicial admissions. The complaint further alleges Allstate later tried to reverse course and obstruct the driver’s efforts to obtain relief.
The lawsuit also escalates what it characterizes as a discovery fight into legal claims including a civil RICO count, asserting an association-in-fact enterprise and a pattern of racketeering activity tied to allegations such as mail fraud, wire fraud, insurance fraud, obstruction of justice, and conspiracy to defraud, and seeks treble damages, punitive damages, and attorneys’ fees. The filing also invokes Texas insurance law and pleads a separate bad-faith claim, including allegations of refusing a reasonable investigation and refusing to comply with discovery obligations.
