Alabama court leaves pharmacy’s $4.75M liability judgment uncovered

The Alabama Supreme Court affirmed summary judgments for the insurer and the agency defendants, leaving OMS Pharmacy responsible after a compounding dosing error.

Alabama’s Supreme Court affirmed that a pharmacy’s $4.75 million consent judgment related to a compounding dosing error is excluded from its general liability insurance coverage, according to Insurance Business.

The case involved OMS Pharmacy, Nationwide Property and Casualty Insurance Company, and two agency defendants, with the $4.75 million judgment stemming from a medication poisoning incident after a computer keying error during compounding in March 2013.

Insurance Business reports that a technician entered the belladonna component in grams rather than milligrams, which made the compounded medication much stronger than prescribed and triggered a years-long dispute over who should pay.

On October 9, 2026, the court affirmed summary judgments for both the insurer and the insurance agency, leaving the pharmacy without coverage as it faced the judgment, with the opinion subject to formal revision.
