Kinsale seeks no coverage in freezer death lawsuit at Florida facility
Kinsale filed a federal declaratory judgment complaint on October 8, 2026, seeking no duty to defend and reimbursement of defense costs it has already paid.
A lawsuit alleges a dementia patient wandered into an unlocked walk-in freezer at a Florida assisted living facility and became trapped, leading to death, and Kinsale Insurance Company is now disputing coverage, according to Insurance Business.
Kinsale, the facility landlord’s surplus lines insurer, is asking a federal court for a declaration of no coverage and no duty to defend, and it also seeks reimbursement of the defense costs it has already paid, the outlet reported.
The complaint names HB Rubicon LLC as the facility landlord, and it was filed October 8, 2026, in federal court in Tampa, Insurance Business said.
Insurance Business said the dispute centers on whether commercial liability coverage was intended to cover the type of injury alleged to have occurred on the premises.
