Utica Mutual seeks ruling it need not defend medical-transport suit

The dispute stems from a March 27, 2023 transport incident, where Utica says the alleged fall occurred after the vehicle ride ended and a completed-operations exclusion should apply.

Utica Mutual Insurance Company has asked a Connecticut federal court to decide that it does not have to defend or pay a claim tied to a medical-transport ride, according to a complaint filed August 12, 2026, in Connecticut federal court.

The fight involves Utica and Markel Group over which insurer should respond to allegations brought on behalf of a passenger’s estate. The underlying lawsuit claims transport companies and a driver knew the passenger could not safely walk inside on her own, left her in her driveway, and that she later fell and suffered serious injuries.

Utica says it is defending its insured, A&M Limo, under a reservation of rights while it argues coverage does not apply. It points to liability coverage language requiring bodily injury caused by an “accident” and resulting from the ownership, maintenance or use of a covered “auto,” saying the passenger was safely transported and left without injury, and that the harm came after the ride rather than from the vehicle.

Utica also argues a completed-operations exclusion bars coverage once the insured’s work is done, and it contends Markel issued a commercial general liability policy that should cover the claim. Utica says it asked Markel to take over the defense and reimburse its costs on April 29, 2026, and the case notes the allegations have not yet been tested in court.
