Eighth Circuit affirms NAR nationwide commission settlement approval
The ruling leaves objectors two weeks from Aug. 19 to seek rehearing or rehearing en banc.
The Eighth Circuit has affirmed a federal court's approval of a nationwide National Association of Realtors commission settlement, rejecting arguments from objectors that the deal was overly broad or procedurally flawed, HousingWire reports.
The appeals court issued its judgment on seven consolidated appeals tied to the settlement's final approval in November 2024, upholding the settlement in full after rejecting claims that the nationwide scope was unjustified, that certain class members were treated unfairly, or that buyers were inadequately represented.
According to the court's judgment and opinion, the nationwide release was considered necessary to obtain the settlement and was supported by evidence developed by the plaintiffs regarding an alleged nationwide conspiracy.
The court also said there was no due-process violation despite a requirement that objectors attend the November 2024 fairness hearing in person, finding that objectors received notice and had an opportunity to be heard, and the parties now have two weeks from Aug. 19 to petition for rehearing or rehearing en banc.
