Insurers add generative AI exclusions to contractor policies nationwide
A review found 2,369 generative AI exclusion records already in force across 49 states and the District of Columbia, covering common contractor lines like general liability, umbrella and excess, and errors and omissions.
A nationwide review of state insurance filings shows insurers have begun adding generative AI exclusions to standard commercial policies used by contractors and small businesses, with the exclusions rising from zero in mid-2025 to filed coverage afterward, according to Insurance Business. Trades Coverage, a licensed insurance producer and marketplace, identified 4,078 state-level records across 49 states and the District of Columbia through July 31. Of those filings, 2,369 were already in force, based on the report. The exclusions trace to six standard forms published by the Insurance Services Office in July 2025, after which carriers started filing those forms one month later. By February, monthly supporting filings peaked at 413, the report said.
