ICE proposes subsidized liability insurance for police in immigration cases
The plan would provide up to $500,000 in liability coverage with a government-subsidized premium of $250 per year, raising concerns about accountability and underwriting.
Insurance Journal says Immigration and Customs Enforcement announced a plan on August 18 to provide subsidized personal liability insurance for state and local police officers working with ICE in immigration enforcement.
According to the outlet, the coverage is intended to shield eligible officers from legal expenses they would otherwise owe in civil suits tied to improper excessive use of force, wrongful arrests, or unlawful search and seizure, and it would also cover legal expenses for officers facing criminal investigations.
The program, Insurance Journal reports, would provide a $500,000 liability limit, with the premium subsidized by the government by $250 per year.
The outlet argues the proposal could create moral hazard by weakening incentives for risk management and raises questions about how underwriting would be handled, what insurers would be involved, and whether the coverage crosses the line between civil insurance and criminal exposure, noting it did not receive responses from ICE for follow-up questions.
