Nationwide sues Pennsylvania contractor over alleged use of slogan
The insurer says a website section targeting homeowners for insurance claims was later removed, and it is seeking an injunction plus damages and attorneys' fees.
Nationwide has filed suit against a Pennsylvania remodeling contractor, alleging the company copied the insurer’s “On Your Side” slogan, according to a complaint filed September 4, 2026. The case is in the US District Court for the Eastern District of Pennsylvania and names NexGen Exterior Home Remodeling of Ambler.
Nationwide’s allegations include that NexGen marketed itself with “On Time · On Budget · On Your Side” and used “On Your Side” across its website and social media. The insurer says it has used the “On Your Side” phrase since at least 1965, holds federal trademark registrations for the slogan, and has spent hundreds of millions of dollars over the past five years promoting its marks.
A key claims-related detail in the filing is Nationwide’s assertion that NexGen’s site once described it as “Your Contractor for Insurance Claims,” aimed at homeowners whose properties had been damaged. Nationwide says that section was removed, pointing to a screenshot dated on or about June 5, 2025.
The complaint lays out seven counts, including claims under the Lanham Act and Pennsylvania law for trademark infringement, unfair competition, and dilution. Nationwide is asking the court to order NexGen to stop using the slogan, hand over profits tied to it, and pay damages tripled for willful infringement, plus attorneys’ fees; the outlet notes the allegations have not been tested in court and no judge has ruled yet.
