Liberty Mutual sues MSC over allegedly damaged guar gum shipment
The insurer is seeking US$43,008.55 and says the guar gum was in clean, good condition when MSC accepted it.
Liberty Mutual Insurance Company has filed a federal lawsuit against MSC Mediterranean Shipping Company over a shipment of guar gum powder that allegedly arrived in New York damaged, after leaving the port of Mundra, India, aboard the MSC Floriana, according to the complaint summarized by Insurance Business. The filing says 720 bags of guar gum were handed to MSC in good order and condition, and a clean waybill was issued on September 13, 2025, indicating the carrier accepted the cargo without noting pre-existing damage. It alleges that something occurred between loading and arrival, and that the shipment either never reached its destination or arrived in damaged condition, with the claim characterized as physical damage. Liberty Mutual is pursuing MSC for US$43,008.55 after paying a claim to Ampak Company. The insurer says it is now acting through subrogation, stepping into Ampak's shoes to recover from the carrier, as described in the lawsuit summary.
