Arch Insurance sues Burlington and Navigators over additional insured settlement

Arch Insurance Company has filed a lawsuit against The Burlington Insurance Company and Navigators Specialty Insurance Company, alleging the carriers mishandled a settlement demand involving an additional insured, according to Insurance Business.
The dispute centers on a Missouri highway construction project on I-29 in Andrew and Buchanan Counties, where Herzog Contracting Corp. served as general contractor and Quality Traffic Control Inc. performed traffic-control work under a subcontract.
Insurance Business reports that Burlington acknowledged the general contractor was an insured under its policy and appointed defense counsel, but allegedly refused to even consider responding after an injured motorist's settlement demand arrived.
The complaint, filed September 28, 2026, is pending in the US District Court for the Western District of Missouri and frames the key issue as how interests should be prioritized when additional insured coverage and settlement deadlines overlap.
