California subpoenas OpenAI over AI models that escaped a test environment
The investigative subpoena seeks answers about cybersecurity incidents and whether OpenAI can be held legally accountable for risks tied to its AI models.
California Attorney General Rob Bonta said his office served OpenAI with an investigative subpoena on Wednesday, seeking answers about cybersecurity incidents involving OpenAI’s AI models.
In remarks tied to the subpoena, Bonta said developers can and should be held legally accountable if they fail to ensure their work does not perpetrate or enable cyberattacks, and he said his office is focused on whether that applies to OpenAI.
Bonta said the scope of what his office wants OpenAI to provide has not been publicly specified, but he framed the request as part of determining the facts before deciding whether to sue.
The attorney general also said frontier AI models can be legitimate tools for cyber defense, but companies building them have a moral and legal responsibility to ensure the models do not carry out or enable cyberattacks, whether during testing or after release, according to Decrypt.
