US states sue Corteva over PFAS liability after Vylor spinoff

The lawsuit, filed in Indiana state court, alleges Vylor took Corteva’s seed and genetics assets without assuming PFAS contamination responsibilities.

Fifteen US states sued agrichemicals company Corteva on Thursday, arguing that Corteva’s spinoff of its seed and genetics business into Vylor was designed to limit exposure to PFAS liabilities tied to “forever chemicals.” Insurance Journal reports the states filed the case in Indiana state court, with a bipartisan group of state attorneys general and the territory of Guam as plaintiffs.

The suit contends that Corteva completed the Vylor spinoff into a separate publicly traded company on Thursday, but that Vylor received what it calls the “crown jewels” of Corteva’s business without taking on responsibility for perfluoroalkyl and polyfluoroalkyl substances contamination.

According to the report, Corteva has been named in thousands of lawsuits stemming from DuPont’s long-running production and sale of PFAS-containing chemicals. The lawsuit alleges PFAS pollution and claims the chemicals have exposed millions of Americans to potential health risks.

Corteva previously said, according to Insurance Journal, that the states’ PFAS claims were “speculative and unproven,” and that it had never made or sold PFAS products. The company was formed from a corporate merger of Dow Chemical and DuPont.
