Microsoft sues JLL over alleged forklift accident at Flatiron offices

Microsoft claims JLL is refusing to cover legal costs tied to injuries from a forklift accident during the 2023 build-out at 122 Fifth Ave.

Microsoft is suing JLL in New York County Supreme Court, alleging the real estate services firm should cover potential damages and related legal costs tied to a forklift accident during the 2023 build-out of the company’s Flatiron offices.

Bisnow reports the lawsuit centers on work overseen by JLL at 122 Fifth Ave., a roughly 150,000-square-foot office project where Microsoft moved in as an anchor tenant in 2023.

Microsoft says JLL was hired as project manager for properties Microsoft occupies under a facilities management outsourcing deal signed in 2013, and that the contract requires JLL to indemnify the tenant against lawsuits related to the build-out, including attorney fees and damages.

In its complaint, Microsoft alleges JLL breached duties tied to the contractual obligations and failed to provide insurance coverage it says it owed.
