Florida estate lawsuit alleges escrow holdback over bonded debts

The complaint, filed July 20, 2026, says the holdback totaled $73,958.19 and was tied to an August 1, 2023 closing that the plaintiff claims was threatened without Fidelity National Title Insurance.

A Florida man who sold his late mother’s home has filed a federal lawsuit against a closing attorney, the title agency and Fidelity National Title Insurance Company, alleging the parties structured a home seller escrow around debts that were already covered by court bonds. According to the complaint, the plaintiff, acting as personal representative of the estate, says he hired an attorney for a $1,500 flat fee to represent the estate in the sale. The filing alleges that attorney owned American Title Corp., the title agency brought in to close the transaction, while Fidelity National Title Insurance Company served as the underwriter, creating a conflict of interest the plaintiff says tainted the escrow process.

The lawsuit also describes how the plaintiff had been litigating personal credit-card debts, paying cash bonds into court to secure underlying judgments while he appealed. The complaint alleges the closing attorney assured him for months that the bonded judgments would not interfere with the sale, then reversed days before the August 1, 2023 closing, with the underwriter seeking additional holdbacks, including what the plaintiff characterizes as paying twice for the same bonded amounts.

In the filing, the plaintiff points to quoted emails from July 21, 2023 and July 26, 2023 in which the attorney discussed escrowing 125% of an unbonded judgment and later said he “misspoke.” The complaint alleges the holdback pressed on the estate came to $73,958.19 and says the plaintiff was told Fidelity would not issue title insurance and the sale would not close if he refused.
