CFPB nominee Brian Johnson faces Senate questions on agency independence

Democrats highlighted a Capital One enforcement case that was dropped and pressed Johnson on whether he would resist political pressure in CFPB actions.

HousingWire reports CFPB nominee Brian Johnson faced sharp questioning during a Senate confirmation hearing about whether he could lead the Consumer Financial Protection Bureau independently, given his prior ties to Capital One and proposed changes to the agency.

Democratic senators cited a Capital One enforcement matter that the CFPB dropped, alongside concerns about a restructuring plan under Acting Director Russell Vought that would reduce examiner staffing from about 350 to 77.

Johnson told senators he does not support dismantling the CFPB and said he intends to carry out the laws Congress assigned to the bureau, describing the agency as a “creature of statute.”

HousingWire adds that Sen. Elizabeth Warren pointed to a January 2025 lawsuit in which the CFPB accused Capital One of misleading customers out of more than $2 billion in interest on savings accounts, and asked Johnson about whether he would notify Congress and the CFPB inspector general if the White House pressured him over an enforcement issue involving a Trump family business or political donor; Johnson declined to commit.
