Small businesses sue over new Trump global tariffs under Section 301
The cases, filed in the US Court of International Trade, target duties of 10% to 12.5% due to begin Friday as earlier tariff authorities are challenged in court.
Small businesses have filed two lawsuits in the US Court of International Trade challenging a new round of Trump administration global tariffs that took effect Friday, saying the government improperly relied on Section 301 of the Trade Act of 1974.
According to Insurance Journal, the administration announced July 23 that it would collect duties of between 10% and 12.5% on imports from most major trading partners, after a probe into alleged failures by roughly 60 economies to prevent forced labor in supply chains.
The plaintiffs argue the new Section 301 tariffs unlawfully replace earlier measures that were struck down by the US Supreme Court, and they point to the need for a country specific inquiry that they say Congress expected when adopting Section 301.
The filings also note that earlier Section 122 tariffs expire Friday, with spokespeople for the trade representative, White House and Justice Department not immediately responding to requests for comment, Insurance Journal reported.
