Mitsui Sumitomo sues Zim and Kintetsu over nearly $800k cargo damage claim
The cargo insurer says four containers of auto wiring harnesses shipped from Vietnam to Los Angeles were delivered damaged, seeking $797,772.84 plus interest and costs.
Mitsui Sumitomo Insurance Company of America has sued Kintetsu World Express and Zim Integrated Shipping Services in US District Court for the Southern District of New York, seeking to recover nearly $800,000 it paid on a cargo damage loss.
The insurer said it covered Sumitomo Electric Wiring Systems and, after paying the claim, pursued the carriers through subrogation. The lawsuit centers on four containers of automobile wiring harnesses that the complaint says were taken on around August 23, 2025 in Haiphong, Vietnam for shipment to Los Angeles, but were not delivered in the condition they left.
According to the filing, the cargo “was delivered in a damaged and deteriorated condition,” leaving the insurer short by $797,772.84, plus expenses, interest, and costs. The carriers were sued under the Carriage of Goods by Sea Act as the primary claim, with additional allegations including negligence, an unfit vessel, failure to care for goods, and breach of contract to deliver the cargo intact.
Mitsui Sumitomo is also asking for 10% pre-judgment interest per year from September 9, 2025, along with 7% post-judgment interest and costs, and it says the bills of lading named the Southern District of New York as the agreed venue for disputes. The complaint identifies the vessel as the M/V Mississippi.
