USI Insurance sues ECBM and former producer over alleged account diversion
USI is seeking more than $100,000 in damages and permanent injunctions after saying two transportation accounts were moved after Anderson left the firm in June 2025.
USI Insurance Services has sued brokerage ECBM and former USI producer Robert Anderson, alleging Anderson violated post-employment restrictions by moving two transportation accounts to his new brokerage. The complaint was filed July 9 in Erie County, New York, after USI says Anderson left USI in June 2025, where he served as a producer and transportation team leader.
USI alleges Anderson later joined ECBM and solicited, diverted, or accepted business from CaraVan Inc. and US Commercial Freight, which USI says were accounts he had serviced while at USI. The lawsuit seeks permanent injunctions, damages exceeding $100,000, punitive damages against ECBM, and other relief.
ECBM and Anderson denied the allegations in an August 3 answer. They argue Anderson was instructed not to solicit former USI customers or violate continuing contractual obligations, and they contend that client decisions were independently made.
The defendants also say ECBM knew of Anderson’s restrictive covenants, hired him in part to pursue USI accounts, and supported the alleged conduct. They further argue the restrictive covenants are unenforceable, overbroad, or improperly applied.
