Court orders NYC to remove list tied to pied-à-terre tax rollout

A Staten Island judge also required the city to start over after ruling the tax’s debut was mishandled, with the city appealing and using an automatic stay.

A Staten Island judge has ordered New York City to remove a public list of about 900,000 homes flagged as potential pieds-à-terre tied to the city’s second-home tax initiative, according to Commercial Observer.

Commercial Observer reports the ruling found the tax’s initial rollout was mishandled and directed the city to begin again, unless a more permanent fix is reached.

The city filed an appeal late Tuesday and invoked an automatic stay, meaning the administration will continue along its current course for now, Commercial Observer said.

Real Estate Board of New York President James Whelan said in a statement that the decision was an important win for thousands of New Yorkers whom the process wrongly swept in, Commercial Observer reported.
