Judge lets Zillow antitrust lawsuit proceed

The court pointed to alleged 35% to 40% referral fees and claims of about 60% audience share in rejecting Zillow’s bid to dismiss.

HousingWire reports that a federal judge in Washington denied Zillow’s motion to dismiss the Dupuis antitrust lawsuit, allowing claims tied to alleged tying arrangements to move forward.

The court cited allegations that Zillow charged 35% to 40% referral fees, held about 60% audience share, and engaged in tying claims involving Zillow Home Loans and Follow Up Boss.

According to HousingWire, the lawsuit was filed in January by Stephanie Dupuis, who says her real estate team finds it difficult to do business without Zillow’s involvement.

HousingWire also notes the suit alleges Dupuis and her team entered the Zillow ecosystem after signing an agreement to become a Prefer, a step she said was driven by Zillow’s market position.
