CRMLS seeks court ruling to block Compass antitrust challenge

CRMLS filed in New York federal court late Monday, asking for a declaratory judgment that its listing cooperation rules are fair, procompetitive, and legally sound.

CRMLS, the operator of the California Regional Multiple Listing Service, has asked a New York federal judge to declare its listing cooperation policies lawful and to block Compass from pursuing antitrust claims, according to HousingWire.

CRMLS sued in the U.S. District Court for the Southern District of New York after Compass threatened an antitrust challenge to CRMLS cooperation rules, with the complaint seeking an injunction preventing Compass from moving forward with those claims.

The dispute focuses on how publicly marketed listings that are not entered into the MLS are handled. CRMLS says Compass has pushed for years to change cooperation requirements in a way that would let brokers share some listings with select audiences while keeping certain properties off the MLS, while still allowing access to other brokers’ listings and MLS data.

CRMLS also argues sellers have options if listings are not entered into the MLS, and it frames its policies as procompetitive and legally compliant, HousingWire reported.
